(1) This is an appeal from a decision of the Family Court which refused to enforce an agreement between appellant, Louis A. Memmolo ("husband"), and appellee, Helen V. Memmolo ("wife"), in which the wife purported to surrender her entitlement to share the husbands military pension. The Family Court ordered rescission of the agreement because it determined that the agreement lacked a valid consideration to the extent that it was based upon the husbands threat to have the marriage annulled and thereby "bastardize the children of the marriage." We affirm the decision of the Family Court although on a different rationale.
