Petition, for a writ of mandamus (RSA 491:7) brought by the Attorney General against the county attorney for Hillsborough County to compel the latter to turn over papers, files and reports of investigation relating to prosecution for embezzlement of one Barnard. The defendant had declined in writing to turn over the files requested by the Attorney General which resulted in the filing of the present petition. The Court (Griffith, J.) transferred without ruling all questions of law relating to the petition for mandamus and the answer, and noted that the plaintiff and defendant ""seek to have the duties, responsibilities and authority of [the Attorney General and the county attorney] under the provisions of RSA 7 clarified."" The events giving rise to this case may be summarized briefly. In April, 1957, Barnard was arraigned on charges of embezzling clients' funds. In May, the plaintiff questioned Barnard at length in the office of his attorney and advised counsel that his recommendations to the Court in respect to sentencing would be materially affected by Barnard's disclosure of the facts. In September, 1957, the grand jury returned eleven indictments for embezzlement against Barnard. In October, 1957, the plaintiff was advised that Barnard was prepared to appear in the Superior Court and plead to the indictments. Whereupon the plaintiff advised the county attorney that the State's recommendation would be not less than twelve years, which the county attorney refused to recommend.
